Welcome to BRKS STUDY SPACE. By enrolling in our courses or using our services, you agree to the following terms. These terms are governed by the laws of India, including the Consumer Protection Act, 2019 and applicable regulations.

Services

We provide educational courses, tutoring, and related training services. The specific details of each course — including syllabus, schedule, fees, and duration — are communicated at the time of enrolment. Any representations made about our courses will be accurate and in compliance with the Guidelines for the Prevention of Misleading Advertisements in the Coaching Sector, 2024.

Eligibility & Parental Consent

• Courses may have specific age, grade, or prerequisite requirements, which will be communicated at the time of enrolment.
• For students below the age of 18 years, a parent or legal guardian must complete the enrolment and agree to these terms on the student's behalf.
• The parent or legal guardian is responsible for the student's fees, attendance, and compliance with these terms, and will be the primary point of contact for all communications.

Enrolment & Payment

• Enrolment is confirmed upon receipt of the applicable fees.
• Fees must be paid by the due date communicated at the time of enrolment.
• Late payments may attract additional charges as per our fee policy.
• All fees are denominated in Indian Rupees (INR) unless otherwise specified.
• Fee details, including any applicable taxes (GST), will be clearly communicated before enrolment.

Attendance, Batch Changes & Rescheduling

• Students are expected to attend classes as per the agreed schedule.
• Requests for batch transfers or schedule changes may be accommodated subject to availability. Please contact us in advance.
• Where a scheduled session is cancelled by the institution, a makeup class or alternative arrangement will be provided.

Conduct

• Students are expected to maintain respectful and appropriate behaviour during all classes and interactions.
• We reserve the right to discontinue services to any student who engages in disruptive, disrespectful, or inappropriate behaviour. In such cases, refunds will be handled as per our Refund & Cancellation Policy.

Assessments & Certificates

• Courses may include periodic assessments, tests, or evaluations as part of the learning process.
• Certificates of completion, if applicable, will be issued upon meeting the course completion criteria communicated at the time of enrolment.
• BRKS STUDY SPACE does not guarantee specific academic outcomes, exam results, or ranks.

Online Classes & Recordings

• Where classes are delivered online, students must comply with the acceptable use policies of the platforms used (e.g. Zoom, Google Meet).
• Classes may be recorded for internal quality and training purposes. Students will be informed when recording is in progress.
• Students may not record, screenshot, or redistribute class sessions without prior written consent from BRKS STUDY SPACE .

Communication Consent

• By enrolling, you consent to receive communications related to classes, schedules, fees, and updates via WhatsApp, SMS, email, and in-app notifications.
• You may opt out of non-essential or promotional communications at any time by contacting us.
• Transactional messages (e.g. payment confirmations, schedule changes) will continue to be sent as required for service delivery.

Intellectual Property

• All course materials, content, and resources provided are the intellectual property of BRKS STUDY SPACE and may not be reproduced, distributed, or shared without prior written consent.

Cancellation & Refunds

• Please refer to our Refund & Cancellation Policy for details on cancellations and refunds.

Force Majeure

• Neither party shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government-ordered closures, or prolonged infrastructure failure.
• In such events, BRKS STUDY SPACE will make reasonable efforts to continue services (e.g. by switching to online delivery) or will provide refunds or credits in accordance with our Refund & Cancellation Policy.

Indemnification

• The student (or parent/guardian in the case of minors) agrees not to misuse any course materials, platform access, or content provided by BRKS STUDY SPACE , and shall be responsible for any loss arising from such misuse.

Limitation of Liability

• BRKS STUDY SPACE is not liable for any indirect, incidental, or consequential damages arising from the use of our services.
• Our total liability in any matter is limited to the fees paid by the student for the specific course in question.
• Nothing in these terms excludes or limits liability in a manner that is not permitted under the Consumer Protection Act, 2019 or other applicable Indian law.

Dispute Resolution

• In the event of any dispute arising from these terms or the services provided, both parties will first attempt to resolve the matter amicably through mediation within 30 days of written notice.
• If mediation is unsuccessful, either party may approach the appropriate Consumer Disputes Redressal Commission (District, State, or National) under the Consumer Protection Act, 2019, or the civil courts in the jurisdiction where the institution is registered.

Changes to Terms

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the updated terms. Material changes will be communicated to enrolled students.

Governing Law

These terms are governed by and construed in accordance with the laws of India.
