Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules that every customer ("you", "your") must follow when using the EtheraGuru platform operated by EtheraEdge Solutions Private Limited ("EtheraEdge", "we", "our", "us"). It supports our obligations as an intermediary under Section 79 of the Information Technology Act, 2000 and reflects the requirements of the Meta WhatsApp Business Messaging Policy. This AUP forms part of, and should be read alongside, our Terms of Service, Privacy Policy, and Data Processing Agreement.

By using EtheraGuru, you agree not to misuse the platform, its WhatsApp messaging features, or the student and parent data entrusted to you. Breaching this AUP may lead to throttling, suspension, or termination, as set out in Section 4.

1. Misuse of WhatsApp Messaging

You may use EtheraGuru's WhatsApp messaging features only to communicate with parents, students, tutors, and staff who expect to hear from your tutoring business. You must not:

add a parent or student to WhatsApp messaging without their consent (opt-in);
send marketing or promotional messages outside the categories a recipient has opted in to;
send messages outside the message-template categories approved by Meta — in particular, no entertainment, political, gambling, or adult content;
ignore opt-out requests. EtheraGuru automatically honours "STOP" and other opt-out signals; you must not re-add or otherwise contact a recipient who has opted out.

2. Misuse of Student or Parent Data

The student and parent data in your account is entrusted to you as the Data Fiduciary. You must not:

process the personal data of a student below 18 years of age without verifiable parental or guardian consent, as required by Section 9 of the Digital Personal Data Protection Act, 2023;
share a parent's or student's contact details outside your tutoring business, or use them for any purpose other than delivering your tutoring service;
message anyone who is not a customer, parent, student, tutor, or member of staff connected to your tutoring business.

3. Misuse of the Platform

You must use EtheraGuru lawfully and only within your own organisation's account. You must not:

attempt to access, view, or interfere with data belonging to another organisation (cross-tenant access);
reverse engineer, decompile, or otherwise attempt to derive the source code of the platform;
use the platform for any purpose that is unlawful under Indian law or that infringes the rights of others.

4. Consequences of Violation

Where we reasonably believe this AUP has been breached, we may:

throttle your WhatsApp messaging if your block or complaint rate exceeds the thresholds set by Meta, to protect your sender reputation and ours;
suspend your account or specific features pending investigation of a reported violation; and
terminate your account for a material breach, or for repeated breaches after notice.

We will act proportionately and, wherever practicable, give you notice and an opportunity to remedy the issue — except where immediate action is needed to protect recipients, comply with the law, or meet Meta's requirements.

5. Reporting a Violation

If you believe someone is misusing EtheraGuru, or you have received a message you did not consent to, please tell us so we can act:

We acknowledge reports within 24 hours and aim to resolve them in line with the timelines published on our Grievance Officer page.

6. Changes to This Policy

We may update this AUP from time to time to reflect changes in the law or in Meta's WhatsApp policies. Material changes are notified at least 15 days in advance.
